These Pre-Order Terms and Conditions (“Terms”) govern the placing of pre-orders (“Pre-order”) with WIDESCAPE. Please read these Terms carefully before submitting your Pre-Order of any WIDESCAPE’S Products. By submitting your Pre-Order, you agree to be legally bound by these terms

Procedure – Mutual Rights and Duties

By submitting a pre-order on widescape.ca and paying the reservation fee using one of the payment methods provided, you can reserve a place on the waiting list to conclude a future purchase contract for a stand-up snowmobile with WIDESCAPE certified dealers. For this, it is necessary that you provide information about your identity, your address and your contact information to WIDESCAPE during the ordering process so that the order can be processed further.

This pre-order does not constitute an agreement for the sale of a stand-up snowmobile and does not contain any binding price, production, delivery or product configuration. In order to complete the purchase of a stand-up snowmobile, you must complete the standard order agreement and the WIDESCAPE purchase agreement (‘Final Sales Agreement’).

You agree and understand that this Agreement does not evidence any warranties, representations or covenants with regards to the stand-up snowmobile, and that such covenants are to be found and documented in the Purchase Agreement. You agree and understand that the Purchase Agreement may be with another affiliate or subsidiary of WIDESCAPE.

You are not obliged to buy a stand-up snowmobile from us and we are not obliged to deliver a stand-up snowmobile to you.

If WIDESCAPE accepts the pre-order, you will receive an e-mail with all the necessary information, in particular a reservation number, which is permanently linked to your place on the waiting list.

WIDESCAPE can refuse pre-orders at its own discretion, for example to avoid oversubscription. If your pre-order is declined, you will be notified, and your reservation fee will be refunded.

If you cancel your reservation, you will irrevocably lose your place on the waiting list and you will receive your reservation fee credited in full.

As soon as WIDESCAPE has determined a binding start of production, you will receive a message to the e-mail address stored with the Reservation. With this e-mail, WIDESCAPE will make you an offer to buy a stand-up snowmobile. You then have the option of bindingly accept this offer within the stipulated deadline and placing a legally binding order.

If this period expires without you having placed a binding order, this is considered a cancellation of the reservation.

Registration

When you pre-order a stand-up snowmobile, you ensure that all of the information provided is correct. It is your responsibility to notify changes to this information by emailing to [email protected]. WIDESCAPE is not liable for inaccurate or outdated information.

Payment

You will be charged the specified fee (the ‘Reservation Fee’) when you place your pre-order. When you place a pre-order, you expressly agree to pay the reservation fee using your specified payment method. Should a final purchase be made, the reservation fee will be deducted from the final sale price.

You will receive an invoice for the pre-order fee.

WIDESCAPE reserves the right to adjust prices. The final price will be communicated to the customer with the final sales contract. In addition, there may be costs for shipping, customs, etc.

Delivery Schedule

Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery is only an estimate, is subject to change, and WIDESCAPE does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment is not met, WIDESCAPE is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your reservation as provided for in Section 5 below.

Cancellation and Refunds

You can cancel your pre-order at any time and receive a full refund of your pre-order 

Buyer or Seller may cancel this reservation by terminating the Pre-order at any time by sending an email to  [email protected] from the email address on file for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If WIDESCAPE cancels your reservation, you will receive a full refund of the Purchase Price without interest. You will receive your refund within a maximum of 20 working days.

Configuration and functionality

At the time of your pre-order, the development of the stand-up snowmobile may not be fully completed. Therefore, the technical data can change at any time. By agreeing to these terms, you represent and warrant us that you understand that stand-up snowmobile configuration is subject to change prior to entering into a definitive sales agreement.

The information you provide to WIDESCAPE is used in accordance with our data protection guidelines and website terms of use, to which reference is expressly made and which are available on our website. Please read our privacy policy of use carefully to understand WIDESCAPE’ practices in relation to your information and how it is handled. Force majeure

Neither you nor WIDESCAPE will be liable for any errors or delays in fulfilling any obligation under this Agreement that result from an event beyond our reasonable control, including, but not limited to, force majeure, pandemic, epidemic, disease, terrorism, war , political insurrection, insurrection, riot, civil or military authority, material change in applicable law or regulation, insurrection, unavailability of materials, strike, earthquake, flood, or other natural or man-made event beyond our control.

Entire agreement and severability clause

We reserve the sole right to change these terms at any time in our sole discretion. If for any reason a court of competent jurisdiction determines that any provision or portion thereof is unenforceable, the remainder of these Terms will remain in full force and effect and the unenforceable provision will be deemed to be amended only to the extent necessary. Your pre-order, order agreement, definitive purchase agreement, our website terms of use, and our privacy policy constitute the final and integrated agreement between you and us.
